If you owe more money on a secured debt, such as a home or vehicle, Chapter 13 allows you to reduce the debt on these assets and to discharge the rest. There are certain stipulations to this rule, so it is best to check with an experienced California bankruptcy lawyer who can assess the details of your situation.
The Fair Debt Collection Practices Act allows you to stop all communications with a debt collector if you choose. You will have to send them a cease and desist letter by certified mail with return receipt requested telling them that you no longer wish to communicate with them. You can choose to continue to receive correspondence by mail, or have no communication whatsoever. The debt collector will still have the right to attempt to collect the debt, but won’t be able to contact you in the process. The two exceptions are if they contact you to tell you that they no longer plan to pursue the debt, or to tell you that they are moving forward to use legal remedies, such as a lawsuit.
As time passes on delinquent accounts, I recommend that you carefully avoid admitting owing the debt. This can re-age the debt and start the time period over again. The best advice is to tell the collector, “I don’t know what you’re talking about and stop contacting me about this debt.” Send them a cease and desist letter requesting that they immediately stop contacting you. Seek the advice of a qualified consumer attorney if the collections don’t end.
If you tell a debt collector that an attorney represents you and give them the contact information for that attorney they have to contact the attorney instead of you. However, if the attorney doesn’t respond in a reasonable amount of time they are once again permitted to contact you.
It has been a common practice of most businesses to extend their service to their clients to gain goodwill and to increase their sales. However, if their clients do not pay their debts in due time this can turn into a much heavy expense. Bad debts if not dealt immediately can become a black mark on a company’s balance sheet and it can affect the company’s credit reputation as well.
In year 2009, the US government introduced the programs of credit settlement to lend a supporting hand to industry of finance. This provided some break to the enormous distress the individuals were facing and who became the sufferers of economic crash. What individuals require to know is the way to trim down their credit card debt with a lawful credit negotiation procedure. Negotiating with Debt Collectors is the best way for removal of liability burden. Negotiating with debt collectors becomes easy once you hire legitimate negotiation companies to give you a support in this process. Negotiating with debt collectors to eradicate your credit card debt is not at all a simple job if you do not have experience and capability.
Abusive debt buyer, collection agencies, and law firms often leave voicemail messages knowing there is a chance that people other than the debtor/consumer will hear the messages.
Things are a little different if you fail to repay the private student loans. If you do not succeed to repay the loan amount within the allotted time period as per your loan agreement, the status for your loan will be quickly transformed into a defaulted one. The time period in this context includes the grace period as well. However, the results of your non-payment can be dreadful, and you may even have to face severe legal actions. The fair debt collection and practice act in case of defaulted private student loans have not proved very helpful. So, you need to apply caution in order to recover from this situation.

Last, you may send the debt collectors a Cease and Desist notice. Collectors pursuing time-barred debts cannot force payment through the courts.
